What's the difference between Hindu Marriage Act and Special Marriage Act registration?

The Hindu Marriage Act applies when both spouses are Hindu, Sikh, Jain or Buddhist and are already married. The Special Marriage Act applies to inter-faith marriages or where you want a civil marriage — it needs a 30-day notice period before registration.

Do both partners need to be present?

Yes. Both spouses must appear before the registrar on the appointment day, along with the required witnesses, to sign the register.

Is a marriage certificate mandatory?

It is the only legal proof of marriage and is required for visas, passports, name changes and most financial and legal processes. Several states have also made registration compulsory.
